Nancy Macharia, TSC CEO, Defends Life Ban as Parliament Reviews. On Wednesday, Members of Parliament convened to discuss the case of a teacher facing a life ban for allegedly defaming a student. Nancy Macharia, CEO of the Teachers Service Commission (TSC), addressed the Public Petitions Committee chaired by MP Bwire Okano, justifying the TSC’s decision. She emphasized the crucial role of the Commission in protecting students from all forms of assault.
In detailing the events, Macharia highlighted the High Court’s acquittal based on circumstantial evidence. However, despite this, the teacher’s deregistration stemmed from the TSC’s independent investigations, which found him guilty.
Moreover, the TSC reinstated the teacher as per Section 31 of the TSC Act, evaluating the case 18 months after removal. Despite this reinstatement, a life prohibition was imposed, restricting him from working in Kenya but allowing employment worldwide.
Before the ban, the teacher underwent a procedural disciplinary process, as clarified by Macharia.
During the parliamentary session, MPs raised questions regarding the Commission’s evidence supporting the minor’s claims. Okano specifically pointed out discrepancies, citing a DNA test that revealed the teacher was not the child’s father.
In response, Macharia staunchly defended the Commission’s duty to safeguard minors, emphasizing the importance of educator accountability. The official statement noted that the criminal court’s conclusions were unable to salvage the irreversibly damaged employment contract. This, in turn, absolved the TSC from strictly adhering to the court’s decisions.
